Hi-Tech and Hollywood

I found this article quite interesting, but it never seems to have reached any meaningful conclusion  :?

The years-long battle over the proper balance between freedom and lockdown in the digital age shows no signs of abating. While Hollywood and high tech slug it out, the $100 billion consumer electronics industry has remained largely on the sidelines. Despite a few renegades, such as Philips Electronics (headquarters in the Netherlands), Archos (France), Pinnacle (Germany), or start-ups such as the former Diamond Multimedia or Sonicblue, electronics makers have a reputation for being beholden to Big Entertainment. And for good reason: nobody buys a DVD player or big-screen television unless there’s killer programming.

In general thats a statement that used to be true but increasingly has no validity.
The fact that most names in the tech industry now own or have controlling interest in many of the media production companies (all mpaa/riaa members) leads me to see a clear conflict of interest with the end consumer of their products.

The top candidate for this is Sony who own a movie studio, many cd pressing plants ,numerous record labels, a cellular phone division, along with a steady output of  hi tech computer equipment and domestic entertainment systems , video production equipment and even the car audio market is one they figure largely in. (did I forget the Playstation.. )

I think the public need to be aware that allowing big corporations like this to use market share to dictate to us, the consumer that we have to have digital rights management because it suits them is the  wrong road to go down.

This is a snippet from the cartels opponents who are not the folks you think they may be ..

Perhaps in part because the U.S. Court of Appeals for the Seventh Circuit ruled against a P2P developer in a case involving different technology (and without taking the California courts' decisions into account), the Supreme Court, announced on December 10, 2004 that it would hear this case and scheduled oral arguments for March 29, 2005. Adding to the already voluminous record, more than 50 amicus, or "friend of the Court," briefs were submitted to the Supreme Court on behalf of the parties on both sides, as were several "neutral" filings.

While few, if any, unexpected parties filed on behalf of entertainment industry interests in this case, supporters of Grokster's and Morpheus' position that the pro-innovation "Sony Doctrine" so critical to our culture and economy must be upheld included an astonishing diversity of respected public and private sector amici:

Yes the people who the Cartel would have you see as pirates and theives  are listed below .

National Association of Shareholder and Consumer Attorneys (NASCAT)
National Venture Capital Association
Intel Corporation
Consumer Electronics Association
Computer and Communications Industry Association
Home Recording Rights Coalition
Cellular Telecommunications & Internet Association
US Telecom Association
US Internet Industry Association
AT&T
BellSouth
MCI
SAVVIS
SBC
Sun Microsystems
Verizon
60 Technology Law Professors and USACM
Consumer Federation of America
Consumers Union
Free Press and Public Knowledge
American Conservative Union
National Taxpayers Union
American Civil Liberties Union
National Library Associations
Internet Archive and Project Gutenberg
Eagle Forum and Educational Defense Fund

I hope you can all see from this, that your far from alone in worrying about the Cartel abusing your common law rights, would you tust a big record compay to play fair with folks after watching them rip off artists and public alike over the last decade ?

An interesting commentary here regarding you dimishing rights that greedy Cartel members are slowly stealing away from you.

While media corporations shell out fortunes to protect their copyrighted content, traditional "fair use" rights for consumers — the freedom, for example, to make personal copies of the stuff you've paid for — seem to be slipping toward irrelevancy. Some DRM practices in development among content owners seem to cross the line from mere anti-consumerism toward outright anti-capitalism.

For DRM (digital rights management ) see the words "proprietory extortion"
Once you have paid these folks to listen to or view a title they seem not to care whether you actually can do so, of course they can always sell you the same title in a different format, again

What worries me is that if you go around the globe a bit you,ll see them using the greedy marketing ploy of charging what the local market can stand, and using region coding to extort that money from you.

Region coding was not designed to be abused for this purpose and I think most folks will not be suprised that the reason they are paying more than what they should be is due to the cartels monopoly position in glogal markets

This commentary is addressed to the Cartel really but I beleive it shows the police of the world in the true sense also.

Hollywood has the tools to track file-sharing; they've sued over 10,000 people. So, why don't police ask Hollywood to help them fight child porn? Why isn't Hollywood sharing this technology? Seems to me that Hollywood could fight child porn if they wanted, so how come they're not?

When the Cartel and police get together on this issue folks will rememebr that, while they sit back and play stupid games with p2p users while children are abused I believe this show what they really care about, Cash

Digimarc, and the content industry, now burn this straw as part of their push for the implementation of technological measures that prevent copyright infringement and assist enforcement efforts after a copyright infringement. The message is clear: P2P file-sharing companies better patch footnote 12. They better deploy (DigiMarc's watermarking) technology, not just to prevent infringement, but to prevent being shut down just because they fail to deploy watermarking, fingerprinting, encryption. Show good intentions, instead of intent. Redesign you open infrastructure, join the DRM club and legalize. In this light the failure to develop technological measures becomes a bit more than an extra, propelling footnote to intent by indications of marketing.

In the meantime the catering Digimarc got today was a "coincidental" victory banquet with the Motion Picture Association of America "at a luncheon discussion with the Congressional Entertainment Industries Caucus". It must have had the sweet taste of success.

I wonder which twelve yr-olds and dead folks paid for that meal, heres wishing all the Cartels lackies a hearty indigestion.
