YouTube Sued Over Infringing Content

This was bound to happen at some stage and it seems like the amount claimed is far out of proportion to any supposed damage.

Although loosing the Viacom deal was a serious blow to YouTube, not very many people expected this latest move. In an announcement made today, Viacom has sued both Google and YouTube in Federal Court in the southern district of New York.

“YouTube is a significant, for-profit organization that has built a lucrative business out of exploiting the devotion of fans to others’ creative works in order to enrich itself and its corporate parent Google. Their business model, which is based on building traffic and selling advertising off of unlicensed content, is clearly illegal and is in obvious conflict with copyright laws. In fact, YouTube’s strategy has been to avoid taking proactive steps to curtail the infringement on its site, thus generating significant traffic and revenues for itself while shifting the entire burden – and high cost – of monitoring YouTube onto the victims of its infringement."

Viacom's statement almost sounds like a lawsuit doctrine against any of the multitude of P2P networks sued out of existence. However Google/YouTube, unlike most P2P companies, is a multi-billion dollar enterprise capable of defending itself in court. While Google/YouTube may be able to defend itself, Viacom's latest move may only fuel an already established doubt regarding the viability of legitimate online video distribution

Lets see how this rolls on over the next few months, it may just be a play to gain more revenue per download or maybe more seriously an industry attempt to corner the market by a backdoor/forced takeover of Youtube, only time will tell.

except for the minor fact that youtube has complied with every request viacom have sent (i have seen the "video removed because viacom asked us" messages all over the place myself), which makes them perfectly safe from the law under the DMCA provisions for ISPs

but the legality of it isn't going to matter, and there isn't going to be a court ruling... since when did 2 companies ever actually take each other to court? it happens extremely rarely, because all they do is threaten to sue, then they start litigation, then they come to a settlement, and whether the original case was valid or not is rarely relevant

It seems the truth of the matter is in front of us all, this is merely an effort by viacom to remove the competition.

I,m sure Youtube will be happy in presenting this "own goal" evidence to the court when and if it gets that far, personally I think Youtube is likely at some time in the future to be steam-rollered by some paid off politician changing the law to suit the media moguls such as Rupert Murdoch or the guy above.

In an interview on local radio (NYC area), a youtube user told of his experiences with being wrongfully caught in the viacom net.

He was a member of a band that released some stuff back in the 80's and uploaded his band's material to youtube.

Viacom claimed his vids were infringing on their copyrights and youtube pulled the vids.

The problem is that Viacom doesn't have any rights to any part of the work.

It seems that Viacom is trying to claim rights to any and all videos that have ever appeared on mtv or vh1, even if they don't own the copyrights to those videos. They think playing them at some time in history gives them that right to claim ownership, when it doesn't.

So how many videos would that make that are uploaded by the actual copyright holders that youtube is being wrongfully sued for?
