I don't know much about copyright, that is why I was reading this post.   But when it stops being informative and becomes a 3 way "my male appendage is bigger than yours" type post, filled mainly with criticism, not facts, then it gets off topic.

Yes you wrote what's inside the thing. Your problem is you named it after property that doesn't belong to you. It belongs to Microsoft. I've noticed that when game makers right games they use all kinds of file extensions that you normally don't recognise to go with windows and windows doesn't have a clue what to do with them. Then if you look hard enough, the game makers, in order to avoid naming their files after windows files to make them work, also make software into the games that tell windows how to use those extensions. Point being that if you had made a driver that didn't have to have a windows driver name in order for windows to use it you could say it's yours. The file you rewrote is a windows file. You can say "I wrote it! It's mine!" all day long. It is a windows driver, you edited it basicly. It wasn't yours. It isn't yours. It won't be yours no matter how many times you say it is. If you want you can say you own the text it took to write it. Be fine with  me. But it's a windows driver that windows recognises because it runs with windows and you named it after a windows driver so windows would know what to do with it. If you wish to make it "yours" give it any name you wish with any extension you wish and make something to tell windows how to deal with it. Otherwise you've done nothing more than rewrite a windows driver that didn't and doesn't belong to you in the first place.

as for your excuse of "well i see no reason for everyone not naming every file file.dat therefore it must be a legal problem"... you really are an idiot aren't you?

so you want to load a system driver for your display card well let's load "nvidia-display.dll", the only file name allowed... oh, but it's an ATI card? oh sorry it's an nvidia, but it's not a "only nvidia card ever made"? erm, i guess we better find some workaround, because using different filenames wouldn't work...

and for the record all drivers use the same file extension, and i believe your comments about programs using their own filenames and registering them with windows to work, i assume you mean file extensions which programs register to open... you know so that .doc files are opened by something that knows how to open word documents, and .png files are opened by something that knows how to open PNG files... well that's obviously a legal thing, i mean it's obvious we should name everything .dat and have the computer magically know which program to open it with (yes, file extensions are the *only* thing used - with some file types you can identify the file type by a header they have added, but that's not some rule of files and certainly can't be used to decide which program to open a file with)

using a certain file name does NOT have anything at all to do with ownership of a file, let's say 2 companies, we'll call them "Company A" and "Microsoft" both make programs and both decide to call them "notepad.exe", does "Company A" suddenly become the creator of "Microsoft"'s program? what about the other way? does "Microsoft" suddenly become the creator of "Company A"'s program? no, the one who created it created it, file names are just a convenient way to reference a specific file instead of trying to remember the location on the disk that you saved a certain file to.

KM that post made you look very angry at me. Do me a favor. Give me any 2 antivirus programs with the same name, made by different companies. Give me any 2 firewall programs, same name, different company. Give me any 2 similar or unsimilar programs with the SAME NAME by DIFFERENT COMPANIES. As a rule they don't do that. And anywhere you've seen it done 1 usually ends up sueing the other. Perhaps you should get a clue. You wrote text or code or w/e you wish to call it. That you can have. The dll you named it after is a windows product, utility, driver, or w/e else you wish to call it and therefor protected under copyright as is stated by Miscrosoft's EULA, as I have also shown that. You may claim it if you wish. As of now I could care less. But as I know you are well aware because I've seen you say it before. Your laws there don't pertain to me here. And fact is by that same saying, you may have something.

 What I see is there are 2 things going on here. You want out of the responcibility that you didn't ask to have put on your shoulders but got put there anyway. Fine n dandy. Hit the high road bud. You yourself have made sure noone cared if you left. Your other problem is not "unique" in its own self. You want out without it looking like it was your choice or that you were wrong. You have made many very valid points KM.

However, one thing you overlooked. As you said, the creator can release the program without it being a copyright issue...  weren't you here and supplied it to this site to be released?
And there were never any terms under which it could be released from this site. (such as a 1 year term or anything of the sort)

You supplying it for free distribution from this site waived any right to have it removed simply because you decide to leave. (check the law on that one)

However, Ghost made a very good point too. We can respect your wish to have it removed (respecting a wish is NOT the same as being forced, and you should have a little appreciation for it's removal) and thus it HAS been removed.

But the real reason it disappeared so quickly from here is simply because no one wants someone acting like a spoiled bully to be in charge of anything. And sadly that is the way you have been acting lately. Why not just resolve to either leaving the winmx community, or returning to be a beneficial part of it again?

seems like a simple thing to decide...

you'll notice i didn't include any requests to remove the original files from the archive, only the modified ones. One of the express things stated repeatedly at the time of the modification is that it's fine for a temporary thing (something stated repeatedly), which in the context of discussions was a week or so, possibly a week and a half at most - I actually allowed more time than that however.

As for nooky: you mean programs like the "WinMXGroup Patch"? ie. the programs name? those are normally trademarked by large companies, however there have been cases of smaller lesser known programs having the same name by accident. However as has been stated repeatedly TRADEMARKS are nothing at all to do with COPYRIGHT, and of course no trademarks are infringed upon by the patch as far as I'm aware, however if they were that would be between myself and the trademark owner.

Mick, like it or don't I'm a person of passion and I say what I feel as well as what I know. And just so you know before your little stupid picture other night was removed I asked that it be left there knowing damn well what it meant. So come off your high horse cause if you're going to follow me around on the forum I promise you're going to  see a lot more emotion than what I put into this thread at one time or another. But since we're on the subject I noticed you didn't make note of KM calling me an idiot or telling me to  get a fucking clue. Whether I'm right or I am wrong if you want to be critical over one users words in any of these threads then I'll ask that you do it fairly.
