Spanish Court Closes Case Against P2P Developer

An attempt by the record industry to sue the provider of file-sharing technologies in Spain has failed. All four majors joined with Promusica to sue Pablo Soto and his MP2P company, which distributes various file-sharing clients, including Blubster, Piolet and Manolito P2P.

According to El Mundo, a Spanish court has now ruled that Soto and his companies provide a neutral technical function, and that there is no liability for any sort of infringement. Needless to say, Soto welcomed the ruling, telling reporters: “We are extremely grateful to the court for finding not only in our favour, but in favour of justice, innovation and in equal access to digital distribution”.

The music industry, meanwhile, will not be impressed.


This was expected but also very welcome news as it confirms the law is unambiguous regarding the neutral position of Peer to peer technologies in Spain, blaming P2P developers for what goes on in a decentralised network is akin to suing the govt for failing to protect you from poor television programming, its the work of ignorant luddites intent on using their financial muscle to expand their near stranglehold monopoly over distribution and production of recorded music to the detriment of all. 

Many folks forget that for most artists who want to build up a serious fanbase P2P networks are an essential hub to gather a following, along with other platforms such as youtube etc, and with no fat cat middlemen to emasculate your copyrights and take 90% of the revenue  most independent artist are wisely shunning the old style monopoly lock-in deals that see creative musical works hoarded till an artist passes away and then sickly monetised to make a fast buck, when dealing with this sort of greed lust mentality after reading this great news many artists will feel happier they no longer need to face "toll booth" organisations that are outdated and bordering on criminal with their persistently misleading claims.

Justice and common sense has triumphed.
