With open source programmers spread out globally, file-sharing clients, much like the networks they connect to, are in many ways invulnerable to litigation. Since little central authority exists which can exert control over development, pressuring developers to comply with the growing “legal” P2P trend is difficult at best. Threatening a US based P2P developer is easy; threatening some guy banging away at his key board, living in his mother’s basement in the middle of the Siberian Plateau is another story.

There are merits to both sides of the debate. Open communication and a free exchange of ideas are absolutely critical to the furtherance of technology; while segmentation helps ensure survival. The question perhaps boils down to which entity is best equipped to meet the needs of the community, rather than debate the methods of how those ends are reached.

I found this article a clear statement of the situation p2p suffers, go commercial, solidify standards and protocols from further improvement ( also risking a Cartel lawsuit) or continue development in an anarchistic fashion to evolve the superior technological result.

That's a beautifully worded statement. Kind of well, good and bad and sums up things nicely
Good cause people can connect and talk freely. Bad because the lack of central authority means that well, then bad things can happen too, on which one has no control.
