It seems the MPAA are trying a new method to harass torrent indexing sites, by asking technically inept Judges to make orders that breach the privacy laws of many countries.

On May 29, TorrentSpy - one of the web’s most famous .torrent dump sites was told by federal judge Jacqueline Chooljian in the Central District of California that despite the site’s privacy policy which states they will never monitor their visitors without consent, they must start creating logs detailing their user’s activities.

The owners have been granted a stay of the order in order to make an appeal, which must be filed by June 12, says Ira Rothken, TorrentSpy’s attorney.

“It is likely that TorrentSpy would turn off access to the U.S. before tracking its users,” said Rothken. “If this order were allowed to stand, it would mean that Web sites can be required by discovery judges to track what their users do even if their privacy policy says otherwise.”

This action follows MPAA action in 2006 against several BitTorrent sites, TorrentSpy included. According to the MPAA, Torrentspy helps others commit copyright infringement by directing people to sites which enable them to download copyright material, an offense claims the MPAA, of secondary copyright infringement.

At the time, Rothken said “It [TorrentSpy] cannot be held ‘tertiary’ liable for visitors’ conduct that occurs away from its web search engine”. TorrentSpy claims it did nothing illegal and suggested the MPAA should sue Google.

An attorney with the Electronic Frontier Foundation referred to the order to demand a defendant log visitor activity and then hand over the information to the plaintiff as “unprecedented.” He continued “In general, a defendant is not required to create new records to hand over in discovery. We shouldn’t let Web site logging policies be set by litigation"

One way or another, it seems that the MPAA is determined to obtain information about TorrentSpy and its users. A complaint issued by TorrentSpy suggests the MPAA paid a hacker $15,000 to steal e-mail correspondence and trade secrets. The hacker admitted this was true


So what are we seeing here folks, well first of all this order is likely to be  not worth the paper its printed on as the US has no legal jurisdiction outside of the US and the site in question is definitely not inside the US, and secondly it seems this is more of an effort to try to win a public relations victory/precedent against certain types of site who are not located in the US and unlikely to appear to defend itself against the global monopoly seeking MPAA and the paid off politicians we see trotted out every time the puppet masters pull their strings.

In reporting this event I would like to encourage you all to not be taken in by the obvious headline grabbing activities of the MPAA and its ilk and continue your normal online activities, their sole mission is to scare people into repurchasing tracks  and other products they already own in a different format and other "double dipping" scams, don't buy anything from these fraudsters, its likely to be the only message they understand, attack the consumer repeatedly and lose customers, attack our privacy and you declare war on our civil liberties, I for one object to any harvesting operations carried out by anyone for no reason other than to target innocent users for fraudulent infringement claims, a practice most here are familiar with, what other reason could their possibly be for asking for logged data of ALL requests for torrent files, folks downloading the latest Linux updates and releases, and all those who produces or require free media of their own for release should see quite clearly this Judges order violates their rights to privacy, personally I would ignore it, after all if a court in China said president bush was share his mail with them would the US agree to this ?

It seems some US courts are fond of making orders that extend beyond the national borders of the US, this activity is held in low esteem by other countries and is laughed at in many others, no jurisdiction means no valid case to answer, a lesson the MPAA is more than aware of from their dealings with the folks at the Pirate Bay, no doubt next they will ask for their users data.

they are already in the netherlands...

that is just a PR campaign that the US government has been bribed to go along with

if they think they are going to be able to enforce any court ruling like that then things could get interesting, they might think they can get away with sending troops to countries like iraq and afghanistahn to enforce their will on others, but amsterdam is an entirely different situation - for a start they'd have to try and keep their troops concentrating on the job at hand... lol

Maybe they have a chance. Torrentspy.com has just release a statement in defence of what the goverment has or is trying to make them do.

Following her decision, Chooljian ordered TorrentSpy to begin logging user information and allowed the company to mask the Internet Protocol addresses belonging to visitors of the Web site. TorrentSpy must then turn the data over to the MPAA. The judge stayed the order pending an appeal, which the company filed on Tuesday. It's not clear when the appeal will be heard.


Seems that torrentspy has taken down their statement and put it in a new blog section.

The only thing in the blog, is the statement which was on the index page of the site but now is hiden away out of site by the looks of it.
