Many ISP companies make complaints (often ficticiously) that they are over stretched, will this new idea make such excuses mute ?

Sounds like a useful idea to me, next time we hear an ISP company complaining that those nasty customers are utilising something which they have paid for, we can remind ourselves that they are complaining purely because they dont wish to put money in any other companies pockets or reinvest in the future.

I don't know how you can simply swap capacities...
mabye for wireless, but in normal networks aren't the lines connected from ISP to user.
They don't pass through a central server where swapping might be possible...
