Stephanie Lenz's YouTube video of her tot dancing to an old Prince song was pulled down at the request of Universal last year after the music label said that the clip infringed on its copyright. Not content with simply having Universal retract its claim, Lenz and the Electronic Frontier Foundation are out to put the squeeze on Universal for issuing a bad-faith DMCA takedown. But Universal told a judge this week that, even though the clip may in fact be "fair use," it was still "infringement" and therefore the initial takedown notice was made in good faith.

This was rediculous the first time i read, and it just keeps going from strength to strength. Their really needs to be some sort of better clarification as to what fair use is, as to me, recording my kids dancing to a song i like is fair use.

recording it is fine, they have issue with sharing it with others i reckon

I agree with Mytheroo. After the report of the guy that arrested, fined, warned or whatever the punishment was for playing music at work in public, none of this surprises me anymore.

I have the perfect idea to get the RIAA off of people's backs in the United States. Instead of going after people in suburban areas and collar workers, visit the ghettos and tell the gangs that they are not allowed to play music in public without paying royalties or whatever it is the RIAA wants.

This will get Al Sharpton and Jesse Jackson to swarm in, take them to court, and win because the government seems too afraid to tell them to shut up.

This puts an outright win on the books to be used in all of the rest.
Downloading is an addiction I do not want to give up.
