Are The French Recording Industry Smoking Crack ?
« on: November 15, 2008, 08:53:32 am »
It seems a French rights group made out of some of the record labels have lost the plot and want to sue all p2p apps out of existence as they assert every program is used to contribute to infringing activity and thus the programmers are in their opinion liable for what the users do, something thats never been true but common sense seem to have taken a holiday in France

Société civile des Producteurs de Phonogrammes en France (SPPF), an umbrella group for several record labels in France, claims that the four file-sharing applications facilitate mass copyright infringement. Although the companies (and applications) themselves have nothing to do with copyright infringement, SPFF believes it has a strong case.

The record labels argue that the Vuze and the others are knowingly distributing software with the purpose to permit unauthorized access to copyrighted works. In essence they are saying that everything, or every application which allows a user to share files, will be indeed used for illegal purposes. In contrast, in the US, companies that don’t encourage their users to commit copyright infringement with their applications, are not acting illegally.

SPFF had already sued the various companies and organizations last year, but until now it has been unclear whether the US based companies behind the applications could be prosecuted under French law. A French court has now ruled that this is indeed possible, which means that they can proceed to court.

Meanwhile, Vuze has appealed the decision. Separately, the company is suing SPPF for defamation based upon several false and harmful statements made by SPPF about Vuze. A different French Court has denied SPPF’s attempt to derail those claims recently , and is allowing the defamation lawsuit to proceed.

Lets hope Vuze is successful and I,m sure Sourceforge will defend itself against this economic terrorism, you have to remeber folks theses recording industry groups are the same ones who have for the last few years paid others to flood p2p networks with fake files and steal p2p users bandwidth, surely there is a case to answer there.

Without a shadow of a doubt.

If they intend to sue such applications, they will need to also sue the following:

All ISP's
All companies that offer email
All companies that make portable HD's and cables
All companies that sell pc to pc connecting cables
Yahoo & MSN (for their messengers) and all other companies that offer similar software

And a whole number of other apps and hardware that i cant be bothered to think of, but pretty much anything that facilitates the movement of data from one computer to another.

With any luck they will be so busy tied up in legal wrangles with most of the worlds tech manufacturers they will forget to make any of their crappy music. I mean please French music? comon outside of Edith Piaf, who i can't stand there isn't any French music is there?
