The general theme of these cases is that IP-addresses are accused of “stealing” copyrighted work. The trolls then request a subpoena from the court so they can ask the corresponding ISPs to reveal the identities of account holders. They then contact the defendants with a settlement offer for a few thousand dollars, telling them that they will be named in the lawsuit if they refuse to pay up.

While some judges are now refusing these cases, there are still plenty who sign off on them. Possibly related, the copyright trolls aren’t getting more friendly. A letter sent by the “Anti-Piracy Law Group,” the latest incarnation of Prenda Law, contains a striking example of a new low.

The letter is part of the LW Systems v. Christopher Hubbard case and was sent after the defendant ignored the first settlement offer. In common with many of these cases it deals with pretty embarrassing pornographic content, but the defendant is also warned that family members and even the neighbors will be informed about the alleged perverse download habits (emphasis added).

“The purpose of this step is to gather evidence about who used your Internet account to steal from our client. The list of possible suspects includes you, members of your household, your neighbors (if you maintain an open wi-fi connection) and anyone who might have visited your house. In the coming days we will contact these individuals to investigate whether they have any knowledge of the acts described in my client’s prior letter,” the letter reads.

The Anti-Piracy Law Group makes it sound like they are doing the defendant a favor, and state that they want to inform the others to ensure that they’re suing the right person. However, SJD points out that fellow copyright troll Steve “Lightspeed” Jones may have given away the true motivation a few years ago.

“People aren’t embarrassed when their neighbors find out they downloaded a few songs, but illegally trading midget, tranny, facials, and teen porn content? There is some news worth keeping from the wife, kids, parents, and neighbors. Please feel free to continue to compare this to the RIAA..,” he wrote in 2010.

Wasn't there a ruling not long ago concerning porn producers who were suing over piracy over their porn products? I think the judge said that illegal porn products aren't protected by copyright law, or some such?

I hate the idea of legal extortion by threat and it should be legislated against and vigorously prosecuted in copyright situations. The cost of being humiliated to family and neighbors for a time may be less than giving those legal arsewipes what they are demanding. It would also be hard to hide a disappearance of thousands of dollars without the wife finding out, who would surely ask why.

It's a rock and a hard place, but the predators are relying upon fear. I'd give thought to returning the favor and telling them that I was making a point of volunteering to family and friends about the threat they were making; this would mean saying something about porn downloads, but the parasites are going to tell everyone anyway if payment isn't made. At least this way one can better control the situation.

What they are doing is in fact covered by the law already as a criminal offence.

I think i remember the article trestor, I think it was a judges comments in a case involving prenda law. The judge wasn't very complementary towards the plaintifs (porn studio) or their law firm.

If downloading porn is likely to be a point of embarrassment for the accused, perhaps it also indicates the equal despicability of those who make the stuff in the first place, and their very act of selling it.

I dont see how sold porn is any less obnoxious than downloaded pirate porn, ergo, what if buyers of the stuff were equally outed?

#1 Freedom of speech and expression. #2 Supply and demand. Nobody is breaking anybody's arm to be in that business and many men and women make a living in that industry.  Of course unlawful material  (underage, rape, )  needs to be prosecuted to the fullest extent of the law.  Keep in mind a lot of homemade and amateur videos by adults for adults are not infringing on any copyright laws so they could be shared without penalty among any community.  It looks like another attempt by the "moral right wing" to intimidate those who chose to download material that some may consider offensive. Sorry folks but since the beginning of civilization we as a species have been curious about sex in general. I can't help to think of the poor soul who is confined to a bed with some kind of debilitating illness not being able to enjoy maybe one small segment of what's left of their life because someone is judging them and decides they can't have even that. Give me a break.  For over 10 years many others along with myself have policed our servers and banned those who we feel have objectionable material.  In essence we do the same thing in those judgment calls because it is a privilege not a right to use our service and I have always felt a need to protect the children from such material. But kids grow up and when boys get to be 15 or 16 they explore this kind of stuff.  Should we tell the neighbors our teenagers like to view porn?  Where does this all end?

im not sure it ever will, the law firm is just exploiting society to make money.
there will always be someone exploiting society to make money and i don't see society changing to point where they can no longer exploit these things.
These kind of things are exactly why we need to protect ourselves online
