Video website YouTube should proactively check if videos infringe copyright, a group representing Japanese rights holders has said.
The Japan Society for Rights of Authors, Composers and Publishers wants videos checked before they go online
Last month 30,000 clips were taken down by YouTube at the request of the Japanese entertainment group.
YouTube's policy has been to remove clips that infringe copyright after it receives complaints.

YouTube, which is owned by Google, has been negotiating with leading copyright holders and reached agreement with several firns, letting the website post copyrighted music videos and other content in exchange for sharing advertising revenue.
The website has licensing deals with CBS and three major recording companies: Warner Music, Universal Music Group and Sony BMG Music Entertainment
.

It seemed enevitable that a system set up to allow video content to be viewed would be abused by folks uploading copyright material, What suprises me is that we havent seen a court injunction yet to close them down.

What suprises me is that we havent seen a court injunction yet to close them down.
A teaser trailer for the movie Spider-Man 3 which was not meant to be distributed yet has appeared on the site half of a dozen time to my knowledge and possibly more times, and each time it was uploaded, it was removed within the hour and once in as little time as 10 minutes.
Downloading is an addiction I do not want to give up.

What I mean to say by that is maybe there have been no court injunctions because they have done such a fast job at removing content quickly. So long as they show that they are cooperating and getting rid of the stuff quickly instead of saying "Yea yea, we'll get around to it" meanwhile first allowing 100,000 hits, then it is not seen a problem or reason for the site to be shut down.
Downloading is an addiction I do not want to give up.

and which courts would there be a problem with?

the US courts where they are located, where they have deals with copyright holders, and where they are not breaking any laws? (as an ISP they are completely legal as long as they act on any reports sent)

or perhaps some other court that has no jurisdiction over them?
