I have been offline for a couple of months. I am back up today and I fire up WinMX and it wont connect. I go searching for help and this is what I find. Apparently I have missed something. I hope the powers that be can find some common ground and rest on a solution for the greater good of the community. Anyways thanx to Omega for his site. I downloaded the patch and I connected again. Yeah!

well im lost, even my energy for all of this is running thin. KM you are what i classed as a friend, i really dont know why it has to end like this, are we all naughty in your eyes and requier punishing, cant you see that winmx is being hurt by all this.

IVe grew up on winmx, since i was 15 years old. Ive always loved winmx, all my electrical friends are on it and even my family. Its defined who i am and what i belive in. But all this isnt what made winmx special to me, this patch that patch, my friends arguing where did it all break down. Quicks, KM, im sorry your friendship broke down, you two have always been a great inspiration to many includeing myself working tirelessly. But i think it truelly got too much for you both, winmx is a great responsibilty but thier has alwaqys been, and always wanted, people to help you both.

I just wish that you would both bash your heads together, get over the bickering that is going on and return to what we all once was, good friends. I notice pie are back on the site, to me that is a good thing but no matter what any of you say you cant ask not for KM's involvement. His coding knowledge is something winmx needs, something we all need. Now KM as a friend, a winmxer, a pain in the side that always asks too many stupid bloody questions, please remove this action, if your running is over at least spread your knowledge to apprentices that are willing to learn. You have tools that will always be your tools and at least bow out with a head held high and the network fending all for itself.

i duno how angry some of you are, but when i read i can see some are letting it cloud thier judgement, i just hope you can all listen to reason, an return winmx back to its former glory.

Well everyone.
Since I read this forum post a few days ago, I've not even bothered to reply,
and last night, I decided to take a shot at my own patch, and there's great news,
I've successfully made my own modified oledlg.dll that hooks to the Connect and Accept Winsock functions,
Now, all I need to do is redirect the old WinMX Caches to yours, then all I'd need to do is add blocking,
But since I don't have a blocklist, I'm kind of lost in that area.
So, I hear talk that you have a blocklist, if you'd provide that for me, it'd be well appreciated.
By the way, when my patch is released, it'll be Open Source.

It's the least I could do to give back to the community that's done nothing but give to me.

One minor problem though, I've made arrangements with my family to go out to Mammoth Lake on Friday(Tomorrow),
we'll be staying in a hotel, and I won't be back 'til Monday. So, that may be a minor delay.

Other than that, when I get back, I'll have the brand new patch for you.

The patch is hardly difficult to replicate.

I remember when the first patch came out and I had to hex edit it to get it to work.

Hes a DMCA sending idiot.

Then again some people get carried away thinking something of small significance is more important than it is.

Or if you like conspiracy theories put 2+2 together. who else likes sending DMCA notices.

Bug, this last week your posts have taken a wild U turn into the realms of common sense, the only downside is i am finding i am in agreement with much of it

BUT, your comment regarding KM "but unfortunately the damage is now done......." i would tend to disagree there, actually, its the best thing that could happen, control over Winmx devolves and spreads and no longer will the community be forced to rely on 1 person of dubious nature. Much as i often enjoy speaking to KM i wouldnt trust him or his software for a second, his track record now includes the recent debarcles of turning on his friends, withdrawing support for the thousands of users on his patch and caches, threats to hand over info to the Cartel, a website used to breach Winmx users privacy and then to top it all off a DMCA notice. The community is WAY better off without someone who boasts that kinds record being in control.

KM's "DMCA Takedown Notice" is a joke. Once you've already given something out there's no law that allows you to go back and change your mind later. There was no license agreement that would prevent further distribution, and therefore if anyone who currently has the patch would simply give a copy to the WinMXWorld team, they are legally licensed to post it on this site.

But of course if someone's gonna make a replacement patch (and open source, too) there's no need to continue relying on KM's work, and that's probably best for the community. So even though it's completely illegitimate, KM's "DMCA Takedown Notice" FUD has probably helped the community in the long run.

Copyright law automatically copyrights all works, and gives the copyright holder (aka creator) all rights to that work, which as you just said there was no license to copy or distribute issued to winmxworld (or anyone else)

Although it was stated that a blind eye would be taken to its temporary use, implicitly granting temporary permission, but of course temporary not perminent and in the context of ghosts bullshit about it only being for a few days - it was used well beyond the timeframe of the implied consent

btw, off topic a little, you probably want to look up what FUD stands for, to avoid looking like an idiot using the term incorrectly again in future

As i see it since KM claims all rights to the WinMX fix and everything there in,
It sure as hell is going to be interesting when the Riaa/Mpaa issue a cease and dissist notice to him as they did to frontcode.
I wonder if he will be just as fast to wish to cliam all rights to the patch then ?

they have no rights over it therefore any request to stop distribution from them is as valid as a piece of toilet paper with "billy, pwease stop sellin copys of windowz cuz i dun like u" scribbled on (although of course the fact it is no longer being distrbuted would make a demand to stop distributing it even more laughable than a demand to billy to stop selling windows)

Rather than being a jackass, maybe you need a quick lesson.

KM freely distributed his patch when he created it and told others they could redistribute it, and no license agreement was attached. Thus, there were no terms to that redistribution. Copyright does not allow you to take that back. His notice is invalid. Now maybe his knowledge of copyright is as limited as yours and thus he truthfully had "A GOOD FAITH BELIEF THAT THE USE OF INTELLECTUAL PROPERTY OWNED BY ME IN THE MANNER COMPLAINED OF IS NOT AUTHORIZED BY ME, MY AGENT, OR THE LAW" (from the notice). But I think he does know better, in which case his only aim can be to spread fear, uncertainty, and doubt (FUD) about the use of his product.

There has always been a healthy amount of fear about using KMware, its just now that KM is helping to open more users eyes to it.

i dont disagree with you either nobby just i feel its such a pitty that someone with so much to offer went all belly up and sideways
but as you rightly point out its most likely the best thing that could of happined to winmx for all the reasons that you noted.......
and just for your own info, now that im not on the drugs that i have been on for the last couple of years due to me breaking my neck you will most likely find that we agree on more then we disagree on...........
i hope that we can leave the bad things in the past and work together on makeing winmx a better place for everyone........
