Kazaa's operators, Sharman Networks, had appealed the judgment. But according to music industry trade group IFPI, the Australian court said that to avoid complete shutdown Kazaa must, as a first step, put in place a keyword filter system within 10 days.

Sharman Networks had said it could not control the actions of an estimated 100 million users.


If even a small portion of that 100 million arrive on WinMX,s doorstep we will be smiling heavily for sure, I really dont see how they can resolve this issue, I,m sure Sharman wished that they had no Australian office now as they would have been untouchable by the Australian courts.

Sharman will still have to work on filtering technology, as per the original ruling, but an amazing technical blunder by the Australian recording industry has prevented the immediate filtration of the FastTrack network.



I think that the Judge has shown a contemptous Australian music industry that his rulings are to be obeyed by all parties involved.
I suppose that this will be rather good news for cash stricken Kazzaa users  the christmas.

It's still a pretty weak ruling; it just gave Sharman a temporary reprieve, some breathign space. If the judge was really that mad with the music industry he'd throw their case out, impose a fine, something.

Hmm very true Lysander, my thoughts where that at least it has given folks time to make plans and not have to worry about messing around changing things over xmas, but I agree its just a temporary lull before the storm.

This is an interesting dance. Installing filters is a dicy proposition; it woudl take Sharman probably about two, maybe three days to install filters; about six hours for everyone to realize what was going on, and then ten minutes to circumvent said filters. The dance then continues, with Sharman trying to out-filter the filter blockers--but, of course, the people who are beating the filters will, and always will, ahve the upper hand. (This is  assuming that Sharman even tries to update their filters, which they certainly won't do if they don't have to; if they can at all get away with it they'll just say "Well, we did our part, see ya RIAA, and by the way I stole your wallet.") This is bad for Sharman Networks, because this could (and in all likelyness will) cause the judge to say "Well, sure, you tried, but it wasn't good enough. Shut down." in actuallity, I think the delay was *bad* for Sharman Networks. If they were clever about it, they could time the filtering so that it went up right before the deadline, claiming that they had to work hard on it in order to make it work, the judge tests it, everythign works fine, Sharman's off the hook. Now however, Sharman has months to implament the filters, and therefore montsh for those filters to get completely obliterated by irate users.

I think the Australian recording industry thought they might be able to damage the use of this client software globally, but they have been unsuccessful and this seems a good way for Sharman to take no further action if they so choose.
Maybe in the future they will  move all operations out of Australia and just open the doors again  :lol:

It seems the australian recording Cartel are not happy with being outmanouvered and are jumping up and down and quoting things Judge Wilcox  said before the Cartel defied one of his orders causing him to allow Sharman to await the febuary appeal, talk about cretins  :roll:

The infringing respondents be restrained, by themselves, their servants or agents, from authorising Kazaa users to do in Australia any of the infringing acts, in relation to any sound recording of which any of the applicants is the copyright owner, without the licence of the relevant copyright owner.


For those that wish to read the full article please follow the above link as it does get a little confusing otherwise  :)

Lets see what happens next, I cannot see that any other Judge is going to overrule one of their own while awaiting both parties to implement actions that had already been agreed upon.

There is bound to be lots of hot ait from the Australian Carteland its obviously designed to save face as the plan to derail the filtering technology and get Kazzaa closed seems to have backfired and resulted in the laid back febuary date for compliance.
My advice to them is stop thinking you can play games with the law to suit yourselves, you broke the court order not Sharman.

Interesting. I have a feeling that this will make the less knowledgable Austrailian users really really mad with Sharman, but I suppose they can deal with that. So do you think that they will ever put filtering in on the client now that they're out of trouble with Austrailia?

Hi Lysander, my personal opinion is no, as this allows them to limit the damage without affecting the global reach of their software, but they have stated they will employ the audilble magic system and so maybe they will and attempt to shore up their legal position in Australia, I wouldnt bother though, its cheaper to leave.
