This has been making a lot of news recently folks with few if any facts on the ground, luckily I located this report that mentions some real facts we can get our teeth into.
http://www.zeropaid.com/news/9154/MPAA+Wins+Copyright+Infringement+Case+Against+TorrentSpyChalk up a hollow win for the MPAA for it was announced yesterday that Federal Judge Florence-Marie Cooper in Los Angeles has terminated an ongoing lawsuit against the once-mighty TorrentSpy in favor of the MPAA. Once one of the world's most popular public BitTorrent tracker sites, it's now more of an afterthought than anything to users after it decided a while back to cut off access by US visitors.
If you recall, back in May the same judge ordered TorrentSpy to begin tracking US visitors to the site by creating and handing over server logs in violation of the sites explicit privacy policy prohibiting such action.
The court in fact found yesterday that TorrentSpy has been systematically hiding and destroying evidence making a fair trial impossible. As a result a default judgment against it has been ruled in the case thereby finding it guilty of copyright infringement
The evidence destroyed included forum postings with references to copyright infringement, site directories referencing copyrighted works, and user IP addresses.
So we can now see the true facts emerge, rather than a hard fought case with a win based on evidence the case was decided soley by one judge, a judge who has become famous in their own right for demanding server RAM be logged, when faced with this kind of luddite its a foregone conclusing the case is not going to be one based on fact and merit.
As for the $110 Million award this judge made to the MPAA, another fact has emerged also, the site operators had already filed for bankrupcy and their is talk the judge knew this, so what we are seeing is just a way to make some noise on behalf of the MPAA, why would a judge want do that you have to ask.
As with most monies obtained by the Cartels legal forays, I suspect the actors and others will never see a cent of it.
