The case in question started in 2016, in an attempt to sue alleged pirates at reduced cost
As the case went on the Canadian Internet Policy and Public Interest Clinic (CIPPIC) took interest in the case.
This week the Federal Court of Canada ruled on the matter and Justice Boswell agreed with CIPPIC.
“I agree with CIPPIC’s submissions that Voltage’s pleadings do not disclose a reasonable cause of action with respect to primary infringement. While Voltage alleges that its forensic software identified a direct infringement in [sic] Voltage’s films, Voltage has failed to identify a Direct Infringer in its amended notice of application,” he writes.
The crux of this case and many others rest on the ability of movie rights owners being able to prove an identified person or persons undertook the alleged infringement , simply pointing to an IP is not now seen as enough evidence as anyone in a household could have undertaken the infringement and not be the actual internet account holder, this case is one of many where the judges have restated this is the case, "prove
who did the infringing or forget it" they are in effect saying.
